By carrying out transactions with Virtual Assets, the User accepts, in particular, the following risks:
3.1. Volatility. The value of Virtual Assets may change sharply within short periods of time, including down to zero. Past changes in value are not indicative of future changes.
3.2. Irreversibility. Transactions on blockchain networks are generally irreversible. Funds sent using incorrect details, on the wrong network or to an address to which access has been lost cannot be recovered.
3.3. Regulatory Risk. The legal regulation of the circulation of virtual assets is changing. Changes in legislation may restrict or terminate access to certain Services or to the Platform as a whole and may affect the ability to dispose of Virtual Assets.
3.4. Technology Risk. Failures, upgrades, congestion and splits (forks) of blockchain networks, as well as failures in the systems of Service Providers, may delay the execution of transactions or make them impossible.
3.5. Cyber Risk. Virtual assets are an attractive target for fraud and cyberattacks. Loss of the means of access to the Account may result in the loss of Virtual Assets.
3.6. Third-Party Risk. The execution of transactions depends on Service Providers, Issuers, banks and payment systems. Their failure to perform or improper performance of their obligations may result in the delay, suspension or impossibility of a transaction.
3.7. Asset Risk. Support for a particular Virtual Asset may be discontinued, and an asset may be withdrawn from circulation, depreciate or be split as a result of a network fork.
3.8. Restrictive Measures Risk. Transactions may be suspended and Virtual Assets frozen on the grounds provided for by law and Section 6 of the Offer, including upon a match with lists of persons subject to targeted financial sanctions.
3.9. Jurisdictional Risk. The legal regime of virtual assets differs across jurisdictions and may change. The User independently determines whether the use of the Platform is permissible under the law applicable to the User and independently performs the obligations applicable to the User, including tax and reporting obligations.
3.10. Assessment Risk. The results of automated risk assessment are probabilistic, differ between providers of analytical services and may not coincide with the decisions of third parties accepting the funds.
3.11. Mini App Risk. Mini Apps are products of Developers. A Developer may fail to perform its obligations to the User, and whatever has been transferred to a Developer may prove non-refundable; the Company does not make and does not guarantee such a refund (Section 10 of the Offer).
3.12. Counterparty Risk. The execution of Trades and the safekeeping of Supported Assets recorded on the Balance depend on the Company’s performance of its obligations. Supported Assets are not insured and are not covered by any deposit protection scheme (clause 7.3 of the Offer).
3.13. Reassignment Risk. The Reassignment Price is determined by the Participants and is not verified by the Company. The activity of a reassigned Referral and the amount of rewards from its transactions are not guaranteed; information on previously accrued rewards is not indicative of future rewards. A completed Reassignment is irrevocable, and the Price paid is non-refundable (Section 13 of the Offer).
